It also explains the choices you have, including how you can opt out of text messages.

By using the Site or providing your information to us, you agree to the practices described in this policy.

1. Who this policy covers

This policy applies to visitors to the Site, individuals who request quotes or information from us, and clients whose insurance we place or service. As a licensed insurance agency, we also provide a separate financial privacy notice to our customers as described in Section 11.

2. Information we collect

Depending on how you interact with us, we may collect the following categories of information.

Contact and identity information. Your name, mailing address, email address, and phone number.

Insurance application information. To prepare quotes and place or service coverage, we may collect information such as date of birth, driver's license number, property and vehicle details, prior insurance and loss history, business information, and other details relevant to the coverage you are seeking. Some of this information may be considered sensitive.

Communications. Records of your correspondence with us, including form submissions, emails, phone calls, and text messages.

3. How we collect information

We collect information directly from you when you complete a form on the Site, request a quote, or contact us by phone, email, or text. We collect website usage information automatically through cookies and analytics tools. In the course of preparing quotes and servicing coverage, we may also receive information about you from insurance carriers, wholesalers, and consumer or data reporting services.

4. How we use your information

We use your information to:

  • Respond to your inquiries and provide the quotes, products, and services you request
  • Prepare, submit, and negotiate insurance applications with carriers and wholesalers on your behalf
  • Service your policies, including renewals, changes, billing, and claims support
  • Send you service messages and, where you have opted in, informational or promotional messages by email or text
  • Operate, maintain, and improve the Site
  • Comply with legal, regulatory, and licensing obligations

5. How we share your information

Placing and servicing insurance requires us to share your information with others. We share information only as described below and do not sell your personal information.

Insurance carriers and wholesalers. We share the information necessary to obtain quotes and place or service coverage with insurance companies, managing general agents, wholesalers, and other market partners.

Service providers. We share information with vendors who perform services on our behalf, such as our agency management system, communications and texting providers, hosting, and analytics providers. These providers are permitted to use the information only to provide services to us.

Legal and regulatory. We may disclose information when required by law, regulation, subpoena, or governmental request, or to protect our rights, property, or safety, or that of others.

Business transfers. If we are involved in a merger, acquisition, financing, or sale of all or part of our business, your information may be transferred as part of that transaction, subject to the commitments in this policy.

Payment processing. If you make a payment through the Site, it is handled by a third-party payment processor. We do not collect or store full payment card details on the Site.

Mobile and SMS data. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We share this information only with the service providers that help us deliver our text messages, and only for that purpose. You may opt out of receiving text messages at any time by sending STOP.

6. Text messaging (SMS)

If you provide your mobile number and opt in, we may send you text messages related to your quotes, submissions, policies, and account, and, where you have agreed, informational and promotional messages.

Consent. By opting in, you consent to receive text messages from Blue Spruce Insurance Agency, LLC at the mobile number you provide. Consent is not a condition of purchasing any product or service.

Message purposes. Messages may include quote follow-ups, submission and application updates, policy and service notices, appointment or document reminders, and, with your consent, informational or promotional messages.

Message frequency and rates. Message frequency may vary. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Opt out. You can opt out of text messages at any time by replying STOP to any message you receive from us. After you reply STOP, we will send one confirmation message and will not send you further texts unless you opt in again. For help, reply HELP or contact us using the details in Section 15.

Privacy of mobile information. We do not share your mobile information or SMS opt-in and consent with third parties or affiliates for marketing or promotional purposes. This information is shared only with the providers that help us deliver text messages and is used solely for that purpose.

7. Your choices

You may choose not to provide certain information, though this may limit our ability to give you a quote or service your coverage. You can opt out of marketing emails by using the unsubscribe link in those emails, and out of text messages by replying STOP. You can also contact us directly to update your preferences or the information we hold about you.

8. Cookies and analytics

The Site uses cookies and similar technologies to operate the Site, remember your preferences, and understand how visitors use the Site. We may use analytics services, such as Google Analytics, that set cookies and collect usage information to help us measure and improve Site performance. Our forms may use anti-spam and bot-detection services to protect the Site from abuse, and those services may collect technical information such as your IP address and how you interact with the form. You can control cookies through your browser settings, though disabling them may affect how the Site functions.

9. Data security

We maintain reasonable administrative, technical, and physical safeguards designed to protect the information we collect. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. Email and website forms are not secure methods of transmitting sensitive information. If you need to share sensitive details such as a Social Security number or driver's license number, please contact us by phone rather than sending them by email or web form.

10. Data retention

We retain your information for as long as needed to provide our services, maintain your policies and records, and meet our legal, regulatory, and licensing obligations. When information is no longer needed for these purposes, we take steps to delete or de-identify it.

11. Financial privacy notice

As a licensed insurance agency, Blue Spruce is a financial institution under the federal Gramm-Leach-Bliley Act. In addition to this Privacy Policy, we provide our customers with a separate financial privacy notice that describes how we collect, use, and protect nonpublic personal financial information and the choices you have. If you would like a copy of that notice, please contact us using the details in Section 15.

12. Your privacy rights

Depending on your state of residence, you may have rights regarding your personal information. Under the Colorado Privacy Act, Colorado residents may have the right to confirm whether we process their personal data and to access it, to correct inaccuracies, to request deletion, to obtain a portable copy, and to opt out of the sale of personal data or targeted advertising. We do not sell personal data or use it for targeted advertising.

Because we place coverage in all fifty states, these rights may apply to you depending on where you live. If you reside in another state with a comprehensive privacy law, including California, Virginia, Connecticut, Texas, Utah, Oregon, Montana, and others, you may have similar rights to access, correct, delete, and obtain a copy of your personal data, and to opt out of its sale or of targeted advertising. Under the California Consumer Privacy Act, as amended, California residents may also have the right to know the categories and specific pieces of personal information we have collected, to limit the use of sensitive personal information to what is necessary to provide the services requested, and to be free from discrimination for exercising these rights.

To exercise any of these rights, contact us using the details in Section 15. We will verify your request before responding and will not discriminate against you for exercising your rights. Note that certain information we hold as an insurance agency may be subject to other laws that affect these rights.

13. Children's privacy

The Site is intended for adults and is not directed to children. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

14. Third-party links

The Site may contain links to websites we do not operate, including carrier and partner sites. We are not responsible for the privacy practices of those sites, and we encourage you to review their privacy policies.
